NOTICE: These Terms and Conditions ("Terms") apply to the website located at papertrails.co and all associated web pages ("Site"), operated by Senda Travel LLC, a Wyoming limited liability company doing business as Paper Trails ("Paper Trails," "we," "us," or "our"). By using our Site, you agree to these Terms. If you do not agree, do not use our Site.

1. About Paper Trails

Paper Trails is a curated discovery platform that connects travelers with independent boutique group travel operators. We do not operate tours, process bookings, or handle payments. When you submit an inquiry through our Site, we facilitate an introduction between you and the relevant operator. All bookings, payments, cancellations, and travel arrangements are made directly between you and the operator, and are governed by the operator's own terms and conditions.

We make no representations or warranties regarding the services, quality, safety, or reliability of any operator featured on our Site. Your decision to book with any operator is made at your own discretion and risk.

2. Use of the Site

You must be at least 16 years of age to use our Site. By using our Site, you represent that you meet this requirement.

We grant you a personal, limited, non-exclusive, non-transferable privilege to access and use our Site for your own personal, non-commercial purposes. We may revoke this access at any time and for any reason.

You agree not to:

• Use our Site for any unlawful purpose or in violation of these Terms

• Attempt to gain unauthorized access to any part of our Site or its related systems

• Scrape, harvest, or collect any content or data from our Site by automated or other means

• Reproduce, distribute, modify, or create derivative works from any content on our Site without our express written permission

You may not use, reproduce, or distribute any of this content without our express written permission.

Some content on our Site, including operator photographs, trip descriptions, and operator profiles, is provided by third-party operators and remains the intellectual property of those operators or their licensors. Paper Trails makes no claim of ownership over such third-party content and is not responsible for its accuracy or completeness.

If you believe any content on our Site infringes your intellectual property rights, please contact us at megan@papertrails.co with a description of the alleged infringement and we will investigate promptly.

 

4. Third-party operators and links

Our Site features content provided by independent travel operators. We do not endorse, guarantee, or assume responsibility for the accuracy of any operator-provided content, including trip descriptions, photographs, pricing, departure dates, or availability. This information is subject to change without notice and should be verified directly with the operator.

Our Site may also contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of any third-party site, and the inclusion of a link does not imply endorsement. You access third-party sites at your own risk.

 

5. Disclaimers

OUR SITE AND ALL CONTENT AND SERVICES PROVIDED THROUGH IT ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE ARE NOT RESPONSIBLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR RELIANCE ON INFORMATION PROVIDED ON OUR SITE, YOUR INTERACTIONS WITH ANY TRAVEL OPERATOR, OR ANY TRAVEL ARRANGEMENTS YOU MAKE AS A RESULT OF USING OUR SITE. TRAVEL INVOLVES INHERENT RISKS AND YOU ASSUME ALL RISK ASSOCIATED WITH ANY TRAVEL YOU UNDERTAKE.

WE RESERVE THE RIGHT TO MODIFY, SUSPEND, OR DISCONTINUE OUR SITE OR ANY PART OF IT AT ANY TIME WITHOUT NOTICE.

6. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SENDA TRAVEL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED USD $100.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

7. Indemnification

You agree to indemnify, defend, and hold harmless Senda Travel LLC and its officers, directors, employees, agents, and successors from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of our Site, your violation of these Terms, or your violation of any rights of a third party.

 

8. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming and the laws of the United States of America, without regard to conflict of law principles. By using our Site, you agree that these laws will apply regardless of where you are located, provided that if you reside outside the United States you may also be entitled to the protections of your local consumer protection laws.

Arbitration: Any dispute or claim arising out of or relating to these Terms or your use of our Site shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. By agreeing to these Terms, you waive your right to a jury trial and your right to participate in any class action or representative proceeding. Judgment on any arbitration award may be entered in any court of competent jurisdiction.

Any arbitration shall take place in Wyoming, or at a location reasonably convenient to both parties. If the value of your claim does not exceed $10,000, Paper Trails will pay reasonable arbitration filing and administrative fees unless the arbitrator finds your claim to be frivolous.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction where necessary to prevent irreparable harm.

 

9. Accessibility

Paper Trails is committed to making our Site accessible to all users, including those with disabilities. We strive to follow Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards where reasonably practicable. If any provision of these Terms is found to be unlawful or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Senda Travel LLC regarding your use of our Site and supersede any prior agreements or understandings.
